Betty Rexford
vs.
U.S. District Court Testimony and Ruling

REXFORD SAYS:

U.S. DISTRICT COURT JUDGE
& SWORN TESTIMONY SAYS:

"Review of the pre-trial depositions taken from numerous City employees reveals no indication that any employee was unduly influenced by me."
SOURCE: Rexford written statement Pomerado News Group 8/28/2009
“City inspectors testified that they felt pressure
from superiors to respond to Rexford’s complaints
and that the pressure came from Rexford herself.”
US District Judge, Hon. Dana M. Sabraw • 7/08/2009
" . . . there exists no 'compelling evidence' that I used the power of my position to 'coerce City inspectors and planners.'”

“City inspectors were called out to write stop-work notices in response to the Rexford’s complaints, and were ordered to issue such notices, even though, in their opinion, the activities were not in violation of the City’s various codes and policies.”
US District Judge, Hon. Dana M. Sabraw • 7/08/2009
“ . . . there was no evidence presented
to establish that I was at fault.”
SOURCE: Rexford response to Recall Notice of Intent 9/2/2009
“ . . . a reasonable inference to be drawn from the evidence is that the City’s positions were attributable to pressure exerted by Betty Rexford.”
US District Judge, Hon. Dana M. Sabraw • 7/08/2009

"I never requested nor did I receive any special treatment."

"Once in a while I'll see the Poway Sheriff and volunteers three or four times a day. Then I know, all the neighbors know, Betty is either on vacation in Pennsylvania or went to Las Vegas. And I have seen the volunteers walking her dogs. Would they do it for you or me?"

A few more interesting facts . . .

1 - Rexford has said in published remarks "I would have preferred to see the case go to trial . . . "

If she really preferred that, she could have done that! Fact is, she and her husband chose to settle
their personal portion of the case. The settlementcould not have happened without their approval.

As for the other portion of the case in which she was sued as an elected official, though her
co-defendant, the City of Poway, chose to settle before the matter went to trial, nothing prevented
Rexford from mounting a vigorous defense . . . that is, if she really preferred to see the case go to trial.

2 - Rexford has trouble remembering key facts in the case

Reading Betty Rexford's deposition, one fact jumps out - Rexford's memory is surprisingly faulty
when it comes to answering questions about her actions and statements. She answered,
"I don't recall" nearly sixty times during her testimony! That's more memory lapses
than all of the other depositions I've read, COMBINED.
